3.  Which legal grounds do we rely on?

We are allowed to collect and process your personal data with your consent. This applies for example where you contact us to request further information. When we collect your personal data in this way, we will make it clear which personal data is required to deliver the service.

We can collect your personal data where we are required to do so to meet our contractual obligations.

This applies for example where you instruct to act on your behalf and sign our appointment letter.    

 

c)  If we are required by Law

We can collect and process your personal data if we are required by law to do so. This might apply where we have to pass details of your investment to a regulator, who is investigating whether a suspected civil or criminal offence may have been committed.

 

d)  Legitimate Interests

We may require your personal data to pursue our legitimate interests as part of running our business in a way which might reasonably be expected and which does not materially impact your interests, rights and freedoms. This would apply where we have identified a potential claim, then we may contact you to advise you of how you might be able to benefit.  

5.  What sort of personal data do we collect?

We may collect various personal data, including the following:  

     -   Details of your contact with us via phone, email and post (for example notes of conversations, details of the specific claim,

          details of any queries or complaints you make, how and when you contact us)  

     -   Your name, address, age, phone number and email address

     -   Details of the specific investments relating to the claim

     -   Copies of documents you provide as proof of your address or identity where required by law (for example copies of your

          passport and drivers licence, which may include details of your full name, address, date of birth and nationality, and copy

          of a utility bill as proof of your address)

     -   Data collected by the use of cookies in your web browser (eg which pages you have viewed)

9.  What rights do you have over your personal data?

You have the following rights over your personal data:

     -  To request access to the personal data which we hold about you

     -  To request that we correct your personal data if incorrect, incomplete or out of date

     -  To request that we stop processing your personal data based on your consent, after it is withdrawn

Where we are processing your personal data on the grounds of our legitimate interest, you may request that we stop using your data due to your specific circumstances and wishes.  We must do as you request unless we genuinely believe there is a legitimate overriding reason which allows us to continue processing your personal data.

2.  How do we protect your personal information?

We take the question of data security very seriously, as we know how much it matters to our clients.

We therefore treat your personal data with the greatest care, and take all appropriate measures to protect it.

6.  What data do we collect from our website?

Our website uses traffic log cookies to help us improve your experience when using our website.  A cookie is a small file of letters and numbers which is placed on your computer browser to allow us to simply track visitor usage of our website.

7.  How do we use your personal data?

We seek to offer you the best possible service. We find the best way we can achieve this is to produce the most complete profile available of you, by combining the personal data we have about you.  

 

The data protection and privacy laws allow us to do this as part of our legitimate interest in understanding our customers and providing the highest possible level of service.

If you choose not to share your personal data with us, or if you refuse to allow us to contact you in certain circumstances, we may not be able to provide some of the services you have asked for. Furthermore, if you restrict our use of your data, or insist it is deleted before the claim is completed, this may well prevent us from obtaining a satisfactory outcome for you.

8.  What do we use your personal data for?

These are the ways in which we use your personal data:

 

To allow us to present the strongest possible claim against the stockbroker or adviser, we require as much information from you as possible on the circumstances at the time of your investment. This will include copies of paperwork you have retained, and your personal statement of what you were told about the shares at the time.

 

This information will be used as the basis of your detailed claim, which will be filed with the Financial Ombudsman Service where the stockbroker or adviser is still trading, or directly with the Financial Services Compensation Scheme (FSCS) via its secure online portal where the stockbroker or adviser has ceased to trade.

 

During the course of your claim, we may need to collect supporting evidence available from third parties. In these circumstances, you will need to provide us with specific written consent that we can make an information request on your behalf (such as a data subject access request), and that we can share proof of your identity as necessary with the third party, in order to obtain the information on your behalf.

 

After you claim has been concluded, we will retain your data for a period of 6 years. We do this in case your information is required after the completion of the claim. For example, if new documentary evidence or legal grounds come to light to further support your claim, it may be possible to appeal the original amount and obtain further compensation.

 

We may also need to share this information with our regulator the Financial Conduct Authority in the course of a routine audit, carried out from time on all regulated firms.

 

Whilst we hold your data, we may contact you on the grounds of legitimate interest should new developments arise that may affect you and we can advise you on how you might be able to benefit.
